5 Week Old Infant Taken From Los Angeles County Mother's Arms Friday Afternoon


On Friday, August 31st, The Department of Children and Family Services (DCFS) and armed Los Angeles police officers entered an El Sereno home and demanded that mother Erica Henderson surrender her 5-week-old infant to their custody.

The events of this past Friday came as a shock to Ms. Henderson. When her newest baby was taken into custody by DCFS, the other Henderson children were also at the home in El Sereno, attending an unsupervised visit with their mother. DCFS removed the infant citing concerns for the infant's safety, while leaving the other 6 children with Ms. Henderson.

“I was looking through the papers and pointed out that the papers didn't say why they were taking my baby. The social worker told me that if I would have just signed the voluntary commitment like he requested that he wouldn't have to do it,” said Erica Henderson about the Friday incident, “They left the house, leaving the rest of my children with me alone. I attempted to pull myself together to complete our family visit.”

Because of past events, the six other children of Jeffrey and Erica Henderson were already in the custody of DCFS.

In May 2010, without a warrant, police used a battering ram to gain entry into the Hendersons' home during an investigation of child abuse allegations made anonymously to 911 operators. The officers strip searched and interviewed the Hendersons' six children and found no evidence of abuse. Father, Jeffrey Henderson, was beaten, taken to a local hospital, and later ticketed with allegedly resisting arrest.

Mr. Henderson filed multiple claims for damages against Pasadena and Los Angeles County, and pursued the appeals process to California Supreme Court. On April 25, 2011, the case was denied by the California Supreme Court. That same day the Hendersons were arrested, and DCFS took their six children, ages 6 months to 9 years, into custody.

Officials claimed that the family had caused psychological damage to their children when they refused to allow the police unlawful entrance to their home. Consequently, Mr. and Ms. Henderson were charged with three more counts of resisting arrest, as well as four counts of misdemeanor child endangerment.

Two months later, Judge Michael Villalobos acquitted the Hendersons and all criminal charges were dismissed. The parents were released from prison, newly homeless and jobless due to their incarceration. All initial accusations against the Hendersons were dropped, yet their children still remain in the custody of DCFS.

Both Erica and Jeffrey have attended court ordered parenting classes. Jeffrey attended court ordered anger management classes. Both have passed required psychiatric evaluations and have professional recommendations that the children be returned to their care immediately.

Mr. and Ms. Henderson do not feel as if the Department has set forth clear guidelines and deadlines as to how and when their children can be returned to them.

"I've never been given a timeline as to when we will move closer to reunification." said Erica, "I am constantly asking if there is something wrong, but the social worker tells me that we are doing well."

Erica and Jeffrey Henderson will appear in court on Tuesday, September 04, 2012 at 9am for a hearing about the recent removal of the youngest of their children. The hearing will take place at Edmund D. Edelman Children's Court, 201 Centre Plaza Dr., Dept 407, Monterey Park, CA 91754.
